How and when are the certificates of length of service issued?

How long does the employer have to issue your paycheck or seniority certificate?

The legal framework in force stipulates that the employer must issue, at the employee’s request, all the necessary documents proving the employee’s status as an employee, within 15 days of the date of the request.

The deadline by which the employer must issue the required documents, as well as the contraventions applicable in case of failure to comply with these obligations, are set out in HG. no. 905/2017 on the general register of employees.

At the same time, upon termination of employment, the employer is obliged to issue to the employee a certificate attesting the type of activity performed by the employee, as well as other information such as salary, duration of employment, seniority in employment and specialty, and an extract from the register (Revisal).

Failure by the employer to comply with or breach of the above obligations constitutes a contravention and is punishable by a fine of between 300 and 1,000 lei.

What personal data of the employee must be included in the employment attestation?

The personal data of employees working in the private sector that must be included in the employment certificate/record of employment include:

  • employee identification data
  • identification data of the company for which he/she works/worked
  • details of the individual employment contract (number and date of conclusion, type and duration of contract)
  • position/grade occupied
  • basic salary including bonuses
  • changes during the performance of the individual employment contract (conclusion, amendment, suspension, termination)
  • length of service and seniority in the specialty
  • unjustified absences and periods of leave without pay
  • date and reason for termination of the individual employment contract
  • information on classification in a higher occupational group.

For employees who work in the public system, the model of the certificate of seniority is established by GEO no. 57/2019.
