Finally, we will get rid of the stamp! Sanctions for the employees of the public institutions, if requested after July 30!

Even if it seems hard to believe, in Romania, we will get rid of the stamp requirement!

This provision actually already existed from 2015, when a paragraph of the Law 316 already eliminated the corporate obligation to stamp the claims, declarations or other documents in relation to institutions or public authorities. However, a large proportion of the public sector employees continued to request abusively the application of the stamp on these documents.

In order to improve this situation, on 30 June 2017 it was published in the Official Gazette no. 507 a Government Ordinance that not only reaffirms the lack of stamp obligation, but also qualifies officials`demand to apply the stamp as being abusive.

According to the Art. VII of GO 49/2017:
“1. The natural persons, private legal entities and entities without legal personality shall not be obliged to affix the stamp on the declarations, applications, contracts or any other documents or writings deposited at the public institutions or authorities or issued or concluded in the relationship with public institutions or authorities. “

2. After the paragraph (1), a new paragraph (11) shall be inserted, with the following wording:
(11) The act of requesting from natural persons, private legal entities and entities without legal personality to affix the stamp on statements, requests, contracts or any other documents or writings, committed by the person from a public institution or public authority constitutes disciplinary offense and entails the disciplinary liability of the guilty person, in accordance with the legal provisions. “

These provisions enter into force starting with 30 July 2017. After that date, it will dissapear the obligation to apply the stamp on any type of documents or writings deposited at the public institutions or authorities.

Stamping obligation still remains valid only for legal persons governed by the public law.
