More specifically, in Article 128 of Law no. 53/2003 – Labour Code, republished in the Official Gazette of Romania, Part I, no. 345 of 18 May 2011, with subsequent amendments and additions, paragraph (2) is amended to read as follows: (2) Pregnant women, nursing mothers and nursing mothers, as well as single parents, may not be required to perform night work.
Until now, the Labour Code stipulated that pregnant women, nursing mothers and breastfeeding mothers and young people under the age of 18 could not be obliged to perform night work. In practice, this law specifies that single people from single-parent families cannot be forced to work at night either.
We would like to take this opportunity to mention that :
– work performed between the hours of 22:00 – 6:00 is considered night work
– the normal working time for night workers shall not exceed an average of 8 hours per day, calculated over a reference period of a maximum of 3 calendar months, subject to the legal provisions on weekly rest periods
– the night employee represents, as appropriate:
a) an employee who performs night work for at least 3 hours of his daily working time;
b) an employee who performs night work for at least 30% of his monthly working time.
