The procedure for registering in the Trade Register is changed

By Law no. 265/22.07.2022, among other things, amendments are made to the procedure of registration in the Trade Register.

The Government adopted OUG no. 73/2022, extending until 31.12.2022 the period for which employers have the possibility to reduce the working time of employees by no more than 80% of the daily, weekly or monthly duration and obtain financial aid from the Government.

Recently, the rules on declaring the patients with Covid as healed and the conditions under which they can return to the Community have changed.

On October 6, the Chamber of Deputies adopted a bill on the modification of the Law on companies No 31/1990.

A new project on tax measures was published on Min. Finance on October 16.

In the Official Gazette n. 741/14.08.2020 was published the Law n. 175 of 14 August 2020 for the amendment and completion of the Law n. 17/2014.

The Romanian Government has launched a new phase of relaxation measures related to the current epidemiological context. In this regard, The Decision no. 465 was adopted on the 11th of June 2020, to amend and supplement Annexes 2 and 3 of HG 394/2020 on the Alert State Declaration.

Also, in the Official Journal n. 508 of 15 June 2020 was published the order of the Minister of Health no. 1,080 of 12 June 2020 amending and supplementing Amendment 414/2020 establishing the quarantine measures for persons in an international public health emergency due to COVID-19 infection.

Here’s a summary of the legislative changes, on the conditions of travel and entry into Romania.

 1. Countries to be exempted from quarantine/house isolation.

The decision 24 of 14.05.2020 issued by the National Committee for Emergency Situations, published in M.O. n. 395/15.05.2020, approved the establishment of a state of alert at national level for a period of 30 days, starting from 15.05.2020.

As the state of alert has facilitated some of the measures ordered during the state of emergency and companies can start to resume their activities, the decision focuses on the definition of measures for prevention and control of infections.

In the Official Gazette n. 245/21.05.2020 has been published the law n. 62/2020 on the concession of structures in rent during the state of emergency. It should be noted that the law grants facilities to both tenants and lockers in order to stimulate negotiations between the parties so that an agreement can be reached for the benefit of both parties.

A law adopted late, we hope, however, will help many companies, including freelancers, for the short term by eliminating the pressure for the fulfilment of certain financial obligations.

According to the decree, tenants can postpone payment of rent on request, without interest and penalty, for the use of registered buildings such as offices, construction sites or houses.

In the Official Gazette n. 311/14.04.2020 was published the Decree no. 240/14.04.2020 on the extension of the emergency situation on Romanian territory for a period of 30 days from 15.04.2020.

In some areas of activity, the new decree provides for changes to the special measures adopted by Decree no. 16.03.2020 on the establishment of a state of emergency on Romanian territory, thus facilitating the relationship with some public institutions.

This measure concerns the activity of the National Trade Register which, from the date of the emergency declaration has registered the reuests related to legal entities and natural persons only upon request for registration of the information in electronic form, attached or logically associated with the electronic signature.

The Government Ordinance no. 32/2020 has introduced some changes regarding the payment of compensation to freelance professionals (as regulated by the Article 3(2) of the law 287/2009 on the Civil Code) which had to stop the activity due to the effects of SAR-Cov-2 coronavirus.

Today, March 16, 2020, the President of Romania signed the Decree on establishing the state of emergency on the territory of Romania, for a period of 30 days. The President shall request Parliament to approve the measure adopted, within a maximum of 5 days from his issuance date.
