What is and how to obtain the emergency situation certificate (CSU)?

According to a draft decision of the Romanian Government to be approved, in order to benefit from the measure adopted by the Government, which will cover from the unemployment insurance budget the benefits enjoyed by employees whose individual employment contracts are temporarily suspended on the initiative of their employer (pursuant to Article 52 (1) (c) of Law 53/2003 – Labor code, as modified and integrated, due to the effects of SAR-Cov-2 virus, companies must obtain a certificate of emergency situations (CSU).

The request for issuing emergency situation certificates (CSU) will be made exclusively via the http platform://prevenire.gov.ro/, the platform will contain a dedicated section and will be operational within 5 days of the adoption and publication of the draft decision in the Official Journal.

How to request CSU

The request for issuing emergency situation certificates (CSU) will be made exclusively via the http platform://prevenire.gov.ro/, the platform will contain a dedicated section and will be operational within 5 days of the adoption and publication of the draft decision in the Official Journal.

Within the platform, the applicant shall provide information on:

  • the economic operator identification data;
  • his contact details;
  • reason for the request;
  • justification of its necessity;
  • data relating to the budget.

The following supporting documents will be uploaded to the platform:

  • the single registration certificate;
  • the CI of the administrator/administrators/legal representative;
  • audited budget, for each month in which there was a decrease in revenue of at least 40 % compared to the corresponding period of the year preceding the application, together with the budget referred to in the report;
  • statement on the honor with which the applicant fully assumes that the statements, and documents uploaded are true, that is the decrease was caused by the occurrence of the emergency situation (a template for completion will be found on http://prevenire.gov.ro/);
  • the competent authority shall inform the applicant of the decision to be notified.

If the supporting documents do not show a decrease in turnover but the operator is in difficulty in the light of the emergency situation, he shall provide further supporting documents in this regard.

All documents uploaded in the electronic application will be signed electronically by the operator’s legal representative or his authorised representative, in which case the application will be uploaded and the authorisation will be uploaded.

How to grant the CSU

The granting of the CSU takes place only during the emergency period decreed by the President of Romania, its validity is for the duration of the grant. The Commission will be set up nell’ambito del ministero dell’economia, dell’energia e dell’ambiente imprenditoriale per analizzare le richieste di rilascio della CSU.

The CSU shall be issued only to economic operators having their principal activity in one of the sectors: Transport, Tourism, HORECA, Events, Advertising, Private Education and Related Activities, Clothing, Footwear and Leather, Services for the population; The list of eligible CAEN codes will be drawn up by order of the Minister for Economic Affairs, Energy and Enterprise.

If the operator fulfils the criteria for obtaining this certificate, the fees for examining applications for the issuance of the CSU will formally verify the existence of documents uploaded by the applicant to the platform, they will generate the CSU and send it by e-mail via the application within a maximum of 5 working days.

Where the supporting documents do not show a decrease in turnover, the groups examining the CSU requests shall verify the additional documents provided and ascertain the existence of the emergency situation and shall send a reply to the applicant regarding the granting of the CSU, within a maximum period of 20 working days.

CSU utility

CSU may be used:

  • in relations with third parties and certifies that the economic operator has suffered the consequences of economic activity in the context of the SAR-Cov pandemic;
  • benefit from tax concessions, provided by central or local government institutions;
  • in the renegotiation of certain contracts or in any relationship with other economic operators;
  • in relation to financial and leasing institutions or any other public institution;
