Law no. 73/2022 published in the Official Gazette of Romania no. 315 of March 31, 2022, introduces “a special form of leave for the care of the child in quarantine or isolation (…), granted to parents for whom the measure of isolation or quarantine was not ordered.”
Thus, in the case of the child in quarantine or isolation, the insured for whom the measure of quarantine or isolation has not been established will be entitled to leave and indemnity for the supervision and care of the sick child aged up to 18 years.
The amount of the allowance for the care of the sick child aged up to 18 years will be 100% of the average gross monthly income in the last 6 months of the 12 months of which the contribution period is constituted. The benefits shall be fully borne by the Single national Health Insurance Fund and shall be granted on the basis of the sick leave certificate issued by the attending physician or, where applicable, by the family doctor who has taken into account and monitored these persons, for a period determined according to the course of the disease and the duration of monitoring.
Currently, the monthly gross amount of the allowance related to the quarantine leave is 100% of the calculation base, while in the case of parental leave, the related allowance is only 85% of the calculation base.
Within 30 days from the date of entry into force of this law, the Ministry of Health and the national Health Insurance House shall amend the rules for the application of the provisions of Government Emergency Ordinance no. 158/2005 on holidays and health social insurance benefits.
