The tax for the re-codification of company’s activities will be eliminated

Accordingly to a Government decision project, that was deposited for public debate and also published on the website of the Ministry for SME’s, Commerce and Tourism, the tax for updating the activities of the companies (the re-codification) will be abolished.

The Minister Ovidiu Silaghi also declared that the companies who already paid the taxes will not get the money back since the law is not applicable retroactively.

The same Ovidiu Silaghi declared: I’ve been unpleasantly surprised to discover that the Trade Registry is getting taxes from entrepreneurs like if the person is proceeding with these changes by its will, not because it is forced to do it. Actually on Wednesday, in the Government meeting, we have a decision project in order to eliminate this tax. It will be taxed only if the entrepreneur will add a new activity to those already existing in the old version of the statutory document.

The Minister explained that the tax varies between 600 and 1.000 lei and they were not many companies who paid it already. The articles of the future Government Decision are supposed to be applicable only until the 1st of March 2009, from there on the taxes being re-introduced.

As a result of the request for updating the list of activities, the Trade Registry Office will release to the companies a new Registration Certificate. Still, based on a specific request and also by the payment of a tax, the Registry will release an excerpt including the list of activities accordingly to CAEN rev. 2 with the mentioning of the main field and others activities.

The requests can be deposited personally by the representatives of the companies or by correspondence with declared value.
