Romanian companies that import or export goods are required to obtain code EORI

Starting with the 1st of July 2009, all the companies who are trading within the European Union will have to obtain an unique code for customs operations, called the EORI code.

The legal provisions that define the EORI code are contained in Regulation (EC) no. 312-2009 and are part of the stipulations of the Council establishing the Community Customs Code, published in EU’s Official Journal no. L 98 dated 17 April 2009.

The procedure for obtaining this code in Romania is regulated by the Order of the President of the National Agency for Tax Administration no. 691/2009 for the approval of the Technical Norms regarding the registration and identification of economic operators in Romania.

According to the information submitted by the Customs Authority, in Romania EORI numbers will be obtained from the Regional irection for excise and customs operations in the area of competence in which the applicant companies are established or, in exceptional cases, at customs offices. Regional offices are located in Bucharest, Iasi, Timisoara, Galati, Craiova, Brasov, Constanta and Oradea.

To obtain the number EORI, the applicant must submit together with the application request, the documents stipulated by Order no. 691/2009:

  • the certificate of registration of the economic operator issued by the Trade Register
  • the incorporation document of the economic operator, with subsequent amendments and modifications, if necessary
  • the representation contract
  • documents which show the VAT identification numbers

The Regional Directorate for Excise and Customs operations will assign the EORI code within a short term, 2-3 days, sending to the applicant a notification of attribution of the code either to the email address indicated by the applicant or at the headquarters of the Regional Directorate.

If after the time of attribution of the EORI number, there occur changes of any data contained in the application and documents submitted, EORI holder is required to notify the competent regional directorate of these changes.

The purpose of holding EORI code is that it “will serve as a common reference in the relations established with economic operators with the customs authorities throughout the territory of the European Union, as well as for the exchange of information between customs authorities and other authorities
